Conditions of Business

The conditions set out below apply to each and every tour. Reference or mention of the “operator” in these conditions means ARS Holidays Pvt. Ltd.

1. The transport, refreshment, accommodation or other facilities or services which are to be supplied in respect of any tour package (“package”) are those specifically started in the tour package itinerary in which the tour contracted for by any person (“client”) is described and no other. Each tour package required the organisation of transport, refreshment, accommodation or other facilities or services. The tour operator makes arrangements with suppliers of such services and facilities and those suppliers contract with the operator as independent contractors. Save for the operator’s contractual rights against the suppliers to any package the operator has no direct day to day control over its suppliers and accordingly the operator accepts no responsibility for any injury, damage, loss, accident, irregularity, or inconvenience which may be occasioned by defect in any object (including a vehicle) utilised by any supplier for the supply of any contracted service or by any act or omission of any supplier or its servants.

2. When requested by the operator the client shall pay a deposit to the operator to secure certain services. In the event of cancellation and on request from the client information will be provided to the client as to any refund that may be due. The full tour price must be paid 30 days prior to the commencement of services together with rooming list.

3. Quotations are valid only to the expiry date stated on such a quotation and are subject to adjustment in the event of services, transport and accommodation not being available: Payment shall be made in the currency in which the quotation is accepted or in which the invoice is issued.

4. All quotations are only valid up to the date stated on each itinerary, hotel price or resort package, car rental service the services must conclude with in the validity of such mentioned period. There are black out dates that may require certain surcharges to be paid where the hotels, airlines or ground services (Like: Guide, car rentals) will be procured at a premium and the same will be payable by the clients these dates are inclusive of National Holidays, Christmas , New Year, Holi, Diwali etc. All such charges will be intimated prior to confirming any bookings for the clients and once confirmed will be payable.

5. All travel arrangements such as flight bookings, reservations of hotel accommodation, reservation of motor transport made by the operator are subject to the booking conditions and cancellation provisions of the supplier of the service.

6. The operator reserves the right to alter routes and itineraries for any reason it considers desirable and will inform clients of any known changes before departure.

7. If in the opinion of the operator the fulfillment of any tour is considered impossible, illegal or in the operators inadvisable because of weather conditions, avalanches, strikes, war, government interference or any other cause not arising from the operators negligence, the operator may at anytime cancel such tour or what remains of it or make any alterations in route, accommodation, price or other aspect thereof as it thinks fit: and any losses or expenses resulting from such cancellation or alteration shall be borne by the client.

8. The operator reserves the right to alter or substitute any services described in the itinerary for any reason it considers desirable. The operator shall advise client of the known changes prior to the services being rendered.

9. The operator shall not be liable for any damage, loss delay, inconvenience or irregularity which may be occasioned either by reason of any defect in any vehicle or article or through the acts or missions of any supplier, whether negligent or otherwise, nor of any servant of such supplier. The operator shall not be liable for any damages, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside the operators control. The operator shall in no circumstances be deemed to be the agent of the passenger or the supplier of any service.

10. The operator accepts no liability in respect of death, injury, loss or damage to person or property arising out of any act, omission or negligence of the operator, the supplier, the operators or suppliers servants, save only in the case of willful act or omission.

11. The operator shall not be liable for any loss or expense arising from the loss of property, cancellation or curtailment of the tour however caused, save only to the extent that such loss of baggage, cancellation curtailment was caused by the operators negligence. If sickness or accident interrupts a tour, the operator shall not be liable for any cost or expense arising therefrom, save only to the extent that such sickness or accidents was caused by the operators willful act or gross negligence. The operator shall not be liable for any refund, either total or partial of passage money paid. The operator recommends that the client advises passengers take out the necessary insurance to protect the passenger against such eventuality.

12. A passenger is solely responsible for complying with the formalities required by the police, customs or health authorities at the point of departure, at the destination or while still in transit. The operator will endeavor to provide clients prior to departure with the latest information concerning such regulations or restrictions but is not responsible and does not accept any liability for any in assurances or omissions.

13. Passengers may not carry any unlawful articles or substances whilst travelling. If any passenger offends against the prohibitions set out herein, the operator will be entitled to immediately exclude from the tour the offender who will be responsible for his or her own repatriation and all costs thereof. The operator will in no circumstances assist any such offender in any dealings or negotiations with any authority.

14. If in respect of any tour the operator has appointed a tour leader then passengers must accept all reasonable instructions of such tour leader and abide by any such decisions which relate to the itinerary including any variation modification in route, accommodation, refreshments, meals or any other service.

15. If a client makes a booking on behalf of a group, he warrants that he is authorised by each and every member of the group to make the reservation on behalf of each and every such member and is acting as their agent and in so doing, binds each such person to the conditions contained herein. Upon the reservation being accepted by the operator, the client warrants that each and every member of the group is bound to the terms and conditions set out herein and indemnifies and hold harmless the operator against any claims of damage, loss or injury which any such person may claim against the operator contrary to the terms hereof.

16. Any information contained in the operator’s brochure/itinerary and price inserts is to the best of the operators belief true and correct, but the operator accepts no liability for any innocent inaccuracies contained therein.

17. The entire contract between the operator and the client is contained in these conditions. No representation term, warranty or condition express or implied shall be considered to be or to have been made or agreed or implied by reference to any other writing, advertisement or conversation. These conditions may only be varied with the written consent of the operator signed by the director of the operator.


Cancellation and refund policy:

Cancellation and refund of land tour:

• The land tour arrangements may be cancelled without any major charges 60 days prior to the commencement of the tour. There will be certain charges like bank charges and exchange rate fluctuation that will be borne by the client and would be up to 10% of total cost.
• If cancellation is between 59-45 days prior to arrival a cancellation of 25% of total cost would be charged.
• If cancellation is between 44-30 days prior to arrival a cancellation of 50% of total cost would be charged.
• If cancellation is between 29-7 days prior to arrival a cancellation of 75% of total cost would be charged.
• If cancellation is less than 7 days prior to arrival a cancellation of 100% of total cost would be charged.

Refunds policy of land tour:


• The refund will be made by the mode the payment was received from the client i.e. if the payment is made by bank transfer the funds would returned to the senders bank, cash payment would be returned by cash, and credit card payment would reversed and would show on the following months billing statement.
• The refund would be processed between 7 to 10 working days from the date of receipt of the request.
• Any additional documents or papers needed to process refunds would be the sole responsibility of the client and on request must be made available to the company to do the needful.
• We are a companionate company and do understand that some times there is an emergency like sickness, ill health, family emergency, death and although we are not obligated to refund under cancellation policy. We may make an exception, subject to certain formalities (i.e. providing of doctors certificate incase of sickness, death certificate incase of death etc.)

Cancellation and refund of Air Ticket:

• All international airlines have different rules and cancellation policies and would be advised at the time of purchase of any such services from our company.
• All domestic tickets booked during a tour are special discounted airfares and are subject to cancellation policy of the airlines booked. The airfares are nonrefundable discounted fares and are subject to 100% cancellation only Taxes will be refunded if the booking is cancelled and received on a working day (between 1000 Hrs and 1600 Hrs) prior to the flight departure date.

Refunds policy of Air Ticket:

• All billing to airlines are settled on a fortnightly basis and if any cancellation is received in the same billing period in which the ticket is issued then the amount of refund will be affected within 7 to 10 working days from the date of receipt of the request.
• If any cancellation is received after the settlement date of the airlines then the refund will be posted in the following fortnight for the date of receipt of the request and will be affected within 7 to 10 working days from the date of receipt of the settlement with the airlines (this may take up to 30 days).
• Any additional documents or papers needed to process refunds would be the sole responsibility of the client and on request must be made available to the company to do the needful.
